Welcome to Mountaineer Dynamics Institute ("MDI," "we," "us," or "our"). By accessing our website or enrolling in our training courses, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. ACCEPTANCE OF TERMS

By using our services, creating an account, or enrolling in a course, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

2. ELIGIBILITY

To participate in MDI training courses, you must:

  • Be at least 18 years of age (21 for certain courses)
  • Not be prohibited by federal, state, or local law from possessing firearms or ammunition
  • Provide valid government-issued identification
  • Complete and sign all required waivers and releases
  • Be in sufficient physical condition to safely participate

We reserve the right to verify eligibility and refuse service to anyone who does not meet these requirements or whom we believe poses a safety risk.

3. COURSE REGISTRATION & PAYMENT

Course registration is complete upon receipt of payment. All prices are in US dollars and include applicable West Virginia sales tax (6%). We accept major credit cards, debit cards, and select cryptocurrencies.

High-risk payment processing notice: As a firearms training business, our payment processing may be subject to additional verification procedures. By making a purchase, you consent to any required verification.

4. CANCELLATION & REFUND POLICY

Please refer to our detailed Refund Policy for complete terms. In summary:

  • 7+ days before class: Full refund or free reschedule
  • 3-6 days before class: 50% refund or reschedule with $25 fee
  • Less than 3 days: No refund; one-time reschedule available
  • No-shows: No refund or reschedule

5. SAFETY REQUIREMENTS

All participants must:

  • Follow all range safety rules at all times
  • Obey instructor commands immediately
  • Wear appropriate eye and hearing protection (provided)
  • Not consume alcohol or controlled substances before or during training
  • Report any medical conditions that may affect safe participation

Violation of safety rules may result in immediate dismissal from the course without refund.

6. ASSUMPTION OF RISK & LIABILITY WAIVER

Firearms training involves inherent risks, including but not limited to: injury from discharged firearms, hearing damage, eye injuries, and other physical harm. By participating in our courses, you voluntarily assume all such risks.

All participants must sign a comprehensive Release and Waiver of Liability before training. This waiver is a binding legal document that releases MDI from liability for injuries sustained during training.

7. INTELLECTUAL PROPERTY

All course materials, training curricula, handouts, and content are the intellectual property of MDI. You may not reproduce, distribute, or create derivative works without written permission.

8. PHOTO & VIDEO CONSENT

MDI may photograph or record video during training sessions for promotional or educational purposes. By participating, you consent to the use of your likeness unless you notify us in writing prior to the course.

9. PROHIBITED CONDUCT

You agree not to:

  • Bring firearms to training without prior authorization
  • Handle firearms in an unsafe manner
  • Harass, threaten, or intimidate staff or other students
  • Attend training under the influence of drugs or alcohol
  • Record training without instructor permission
  • Share course materials with non-participants

10. GOVERNING LAW

These Terms are governed by the laws of the State of West Virginia. Any disputes shall be resolved in the courts of Monongalia County, West Virginia.

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law, MDI's total liability for any claim arising from these Terms or our services shall not exceed the amount paid by you for the specific course giving rise to the claim.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our services after changes constitutes acceptance.
